Now you know about the 90 day insurance claim, the 180 day charge offs, the unauthorized sale to debt collection companies. Let’s talk a bit about contract law.
Contract law requires every contract to have certain elements in order to be valid. One is offer and acceptance. There has to be an agreement between you and the other party. You NEVER had an agreement with the debt collection company. Or did you?? Did you sign anything with the debt collector? Of course not. That’s where validation and verification comes into play. You have to have everything validated. Remember: validation is providing certified documents. Verification is sworn testimony declaring those certified documents to be true. Validation and verification have to go together. One without the other is not valid.
Remember contract law requires a valid contract. Request that they show you a contract signed by you. If you didn’t sign a contract with the third party debt collector, then there is no valid contract. The debt and transfer of your information was bought and done without your consent. The debt collector is not named on the original contracts. So they cannot validate your request.
